 SPECIAL MEETING

BROOKFIELD PLANNING COMMISSION

THURSDAY, DECEMBER 20, 2007- 5:30 P.M.

MEETING ROOM #133 – TOWN HALL, 100 POCONO ROAD

 

  1. Convene Meeting:  Chairman Miller convened the Special Meeting at 5:32 p.m. with the following Commission members present: R. Miller, Chairman; J. Van Hise, Secretary; Regular Members: M. Burr and W. Conner.  Also present:  Acting Town Attorney, J. Sienkiewicz and Town Director of Public Works, Ron Klimas.

 

Absent:           B. Gregory, Regular Member.

 

A motion was made by J. Van Hise, seconded by M. Burr, to go into Executive Session at 5:32 p.m.  Motion carried unanimously.

 

  1. Executive Session – 101 Obtuse Hill Rd. # 200200378: “Whispering Glen Subdivision” -Tuccio Development- Discussion of Proposed Settlement with Council

Correspondence: Stipulation from the Judicial District of Danbury Superior Court.

 

The Commission remained behind closed doors in Executive Session.

 

A motion to come out of Executive Session at 5:47 p.m. was made by J. Van Hise, seconded by W. Conner, and carried unanimously.

 

3.         101 Obtuse Hill Rd. # 200200378: “Whispering Glen Subdivision”- Tuccio Development- Acceptance of Proposed Settlement  No one present.  A motion was made by Jon Van Hise, to empower Attorney Sienkiewicz to proceed with the Stipulation as approved as written.  Said stipulation should become part of the public record.  The reasons for authorizing this settlement is that the Planning Commission believes this stipulation provides the commission with all the remedies it believes is necessary with regard to this project and the stipulation is in the best interest of the Planning Commission and the Town of Brookfield.  Motion seconded by M. Burr and carried unanimously.    

 

The Commission also authorized Attorney Sienkiewicz to make “minor technical corrections” such as typographical errors, where the need may arise.  R. Klimas will work with Art from Tuccio Development on this project.  Several Commissioners were not fully in favor of this proposal, but agreed to go along with it in the best interest of the Town, feeling it was a fair compromise.  The As-built drawings are due to the Wetlands Commission by February 1, 2008.  Attorney Sienkiewicz will return to court tomorrow morning on this matter.

 

4.         Adjourn:  A motion was made by M. Burr, seconded by J. Van Hise, to adjourn at 5:51 p.m.  Motion carried unanimously.
